Prices:

All prices are published exclude value added tax (VAT). VAT is payable regardless of the Delegate’s country of origin; the point of supply for VAT purpose is the location of the course. The published prices do not include any travel, accommodation or living expenses which the delegates may incur in attending unless specifically mentioned on the training booking agreement. All pricing quotations are valid only for 7 days from the date they are first sent to the Customer.

Payments:

The course fees, including VAT, are payable 20 working days before course start date. Customers wishing to make payments made from non UK accounts or credit cards must be responsible for all bank charges in relation to the overseas transaction; this includes charges levied by the customer’s bank and that levied by the bank of The Knowledge Academy Ltd, in accepting this specific transaction.

Any late payments will be subject to a late payment charge at the rate of 5% over the Bank of England base rate. Payments can be made by major credit and debit cards including American Express.

Where a Purchase Order is issued must clearly state the purchase order number, course dates, full Invoice amount and contact details for invoicing. When more than one course is booked on the same booking form, full payment for all courses, including VAT, is required 20 working days before the commencement of the first course.

Where the relevant invoice has not been paid by course start date then we have the right to refuse the delegate(s) entry to the course. In these circumstances, the invoice in question will remain payable in full. We reserve the right to withhold examination results and certificates until all payments have been made. Administration fee for cancellations are payable immediately upon invoice. The Terms of this agreement override over any other terms of business or purchase conditions put forward by the Customer.

Once a payment has been made, may it be a deposit or full payment, over the phone or on the website  by the following methods: Debit Card, Credit Card, American Express, the delegate is adhering to The Knowledge Academy terms and conditions irrespective if a booking form has been signed. In addition, if payment has also been received via bank transfer or cheque the delegate is adhering to The Knowledge Academy terms and conditions irrespective if a booking form has been signed. 

Purchase Order/ identification number:

If a purchase order is provided there is no need for any other confirmation (i.e. booking forms to be signed). The purchase order constitutes as a legal offer to buy products or services. The Purchase Order is deemed as a confirmation of an order and is bound by the cancellation & re-scheduling policy set out in this document.

Cancellation for website orders:

All orders placed through the company’s websites are non cancellable and non refundable.

Cancellations non website orders:

Unless written cancellation is received at least 20 working days before the start date of the course, the fees including VAT are payable in full and non refundable. All cancellations are subject to a minimum administration fee of £99 + VAT. The administration fees are payable immediately upon cancellation.
Notification of all cancellations must be made in writing to - The Knowledge Academy Ltd. Orchard Lea, Drift Road, Winkfield SL4 4RU

Should a course booking be made less than 20 working days in advance of the start date of the course, the above cancellation terms still apply and fees are payable in full and non refundable.

If the cancellation is more than 20 working days in advance of the course and the Delegate has been sent any pre course work either physically or electronically an additional charge of £250 + VAT per delegate will be payable upon cancellation.

Re-scheduling courses or exams:

Changes to a course or exam booking more than 20 working days in advance of the course will incur an admin fee of £99 + VAT (per change). The administration fees are payable immediately upon rescheduling. Rescheduling courses or exams less than 20 working days of the start of the course is not permitted.

Refunds:

In the case where a refund is made to the Customer by The Knowledge Academy Ltd, the refund may take up to 20 working days to be processed. Refunds will be processed using the same payment method that the original payment was made. All deposits are non-refundable, upon payment of your deposit you are contracted to pay the confirmed course fee at the time of booking, and The Knowledge Academy reserve the right to change prices at any time at their discretion. Upon payment of a deposit, the delegate is adhering to The Knowledge Academy terms and conditions. Refunds will be made in GBP (£) for the exact amount originally received, less any cancellation or pre course fees that may be payable. The Knowledge Academy Ltd will not be liable for any fluctuation in exchange rates or bank charges for overseas refund transactions.

Knowledge Passes are valid for up to a maximum of 12 months from the date of the order and are non- transferable and non refundable.

Deferring of Practitioner Examinations:

Upon commencement of the training course, The Knowledge Academy Ltd accepts that occasionally an individual delegate may wish to for personal reasons; defer a practitioner examination to a later date. In this case, the delegate will be subject to a rescheduled exam fee of £299 + VAT and must reschedule the examination within 20 working days of the original exam date, subject to availability. We do not allow the deferral of foundation examinations. Delegates must inform The Knowledge Academy Ltd of the deferral at least 24hours in advance of the original exam time.

Changes to Courses:

The Knowledge Academy Ltd reserves the right to change any part of a published course; if this is caused by circumstances beyond our control. The Knowledge Academy Ltd reserve the right to cancel or reschedule any course and will advise the customer as soon as the change is known. The Knowledge Academy Ltd will use all reasonable endeavours to avoid changes of this nature. The contents of course timetables are intended for general guidance only. Any typographical error or omission in any sales literature, administrative documentation, course materials, invoice or other document shall be liable to correction without any liability on the part of The Knowledge Academy Ltd. The Location and course date of the course will advised upon booking. The Knowledge Academy Ltd reserve the right to change the location and will advise the customer has soon as the change is known. The Knowledge Academy Ltd will not be liable for out of pocket expenses due to cancellation or any other changes to venue or programme.

Non Attendance:

Non-attendance of any course for any reason whatsoever is deemed to be a cancellation with no notice and payment is due in full.

Course Suitability:

The Customer accepts that it is their responsibility that the course booked is suitable for the requirements and abilities of the delegates attending. The Knowledge Academy Ltd's employees may recommend courses or learning solutions, however, the assessment and the final decision concerning suitability of the course is the Customer's responsibility. In cases where we have made recommendations, we do so in good faith and will not be wilfully misleading. All public and onsite training courses are delivered only in English and all Delegates must be sufficiently proficient in the English language before attending the course.

Admission:

The Knowledge Academy Ltd reserves the right to refuse admission to any person whom it considers in its absolute discretion to be unsuitable for whatsoever reason.

Booking on behalf of the Delegate:

In all cases the customer undertakes to bring these terms and conditions to the attention of delegates. It is the customer’s responsibility to ensure that the delegates receive all the relevant information including the joining instructions and that they meet the eligibility and published prerequisite requirements.

Onsite Training on Client Specified Site:

It is the Customer’s responsibility to provide all facilities, equipment and set up required for trainer to deliver the training. The Knowledge Academy Ltd reserves the right to cancel or discontinue the course if, in the Trainer's opinion, the venue, equipment or conditions are unsuitable.

Trainer Expenses:

Trainer expenses for private, onsite or closed courses will be charged as agreed at the time of the course booking, as stated on the Training Booking Agreement.

Shipping:

Additional charges will be incurred for shipping of pre-course work or certificates to locations outside of the UK. Please contact your learning advisor for further information.

Copyrights:

All intellectual property rights for all course materials shall remain the property of The Knowledge Academy Ltd. The Customer agrees not to reproduce, sell, hire, lend or copy the course materials or use them except for the purpose of personal reference. The Knowledge Academy Ltd warrants that it will not knowingly include any copyright material in its course materials without license or consent.

Warranty & Liability:

The Knowledge Academy Ltd liability for loss and damage shall be limited to a claim for damages. The maximum aggregate liability will be the charges for the course out of which the loss or damage has arisen. The Knowledge Academy Ltd will not accept liability for death or personal injury. The Knowledge Academy Ltd will not be liable for indirect, special or consequential loss (including loss of anticipated profit or data), howsoever arising, even if it has been advised of such potential loss. The Knowledge Academy Ltd will not be responsible for any damage resulting from any computer viruses arising from software installed on customer computer systems.

Personal Belongings:

Personal belonging or items belonging to the Delegate on the Delegate’s possessions brought onto training courses are the sole responsibility of the Delegate. The Knowledge Academy Ltd accept no responsibility of the items or any loss or damage that may occur during the course.

Non Solicitation:

For 12 months following either the invoice date or the date of course delivery, of any contract carried out for the Customer by The Knowledge Academy Ltd or an associate company of The Knowledge Academy Ltd, the Customer, will not directly nor indirectly employ or solicit for employment any employee of The Knowledge Academy Ltd. If the Customer breaches this clause, The Knowledge Academy Ltd shall be entitled to recover from the Customer a fee of 50% of the gross annual salary of the employee of The Knowledge Academy Ltd solicited for employment.

Assignments:

The Knowledge Academy Ltd may assign its interests in all or part of this agreement. The customer may not assign or transfer this contract without the express written permission of a Director of The Knowledge Academy Ltd.

Deviation:

No deviation from these terms and conditions will be allowed without the express written permission of a Director of The Knowledge Academy Ltd. No communication either verbal or printed on our websites will override these Terms and Conditions. If in any case any of these conditions shall be held to be invalid or shall not apply, the contract and the other conditions shall remain in force and effect.

Force Majeure:

The Knowledge Academy Ltd shall not be in breach of this contract if the provision of services are delayed or cancelled or reduced through any circumstances beyond it's reasonable control including acts of God (including but not limited to, fire, flood, earthquake, storm, snow, hurricane or other natural disaster) sickness, war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service. Delegates must ensure that they can attend the training courses which they are scheduled to attend. The Knowledge Academy Ltd will not be held liable, financially or actually, for their non-attendance, whatsoever the reason may be.
